Terms of Use

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and Pearlbrains Ltd ("Gospel Hub", "Company", "we", "us"). By creating an account, downloading the app, or using any feature of the Service, you represent that you are at least 13 years of age, have read and understood these Terms, and agree to be bound by them and our Privacy Policy.

2. Description of Service

Gospel Hub is a gospel music streaming platform that provides access to a catalogue of songs, albums, playlists, artist content, and related features (collectively the "Content"). The Service is available via our Android and iOS mobile applications and at gospelhub.app.

3. Account Registration

• You must provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorised use of your account.
• Each person may register only one account. Duplicate accounts may be terminated.
• You may not create an account on behalf of someone else without their permission.

4. Subscription Plans and Billing

Gospel Hub offers both free and paid subscription tiers ("Plans"). By selecting a paid Plan:

• You authorise us to charge your payment method on a recurring basis at the applicable rate.
• Subscription fees are billed in advance on a monthly or annual cycle.
• Prices are subject to change with 30 days' notice via email or in-app notification.
• Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date.
• No refunds are provided for partial billing periods, except where required by law.
• Family Plans are limited to 6 accounts residing in the same household.

5. Acceptable Use Policy

You agree to use the Service only for lawful purposes. You must NOT:

• Reproduce, redistribute, transmit, or create derivative works from any Content without authorisation.
• Use the Service to upload, transmit, or distribute any malware, viruses, or harmful code.
• Attempt to gain unauthorised access to any part of the Service or its related systems.
• Use automated tools, bots, or scrapers to access or extract Content.
• Circumvent, disable, or interfere with security or DRM features of the Service.
• Use the Service for commercial purposes without written authorisation from Gospel Hub.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Harass, abuse, or harm other users of the Service.

6. Content and Intellectual Property

All music, artwork, logos, and other content on Gospel Hub is protected by copyright and other intellectual property laws.

• Gospel Hub grants you a limited, non-exclusive, non-transferable licence to stream Content for personal, non-commercial use.
• This licence does not include the right to download (except for offline listening within the app under a qualifying subscription), copy, or redistribute Content.
• The Gospel Hub name, logo, and trademarks are the exclusive property of Pearlbrains Ltd.
• Gospel Hub respects intellectual property rights. If you believe your copyright has been infringed, please contact us at copyright@gospelhub.app.

7. User-Generated Content

If you submit any content (playlist names, comments, profile information), you grant Gospel Hub a non-exclusive, worldwide, royalty-free licence to use, display, and distribute that content in connection with the Service. You represent that you own or have the rights to submit such content and that it does not violate any third-party rights or these Terms.

8. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may terminate your account at any time through the Settings page. Upon termination, your right to access the Service ceases immediately. We are not liable for any termination of access to the Service.

9. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM VIRUSES.

TO THE FULLEST EXTENT PERMITTED BY LAW, GOSPEL HUB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Uganda. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Uganda. If you are using the Service from outside Uganda, you are responsible for compliance with local laws.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or prominent notice in the app at least 7 days before changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
